What are the Three Ways to Establish Paternity?

At Birth in the Hospital

When two parents are married at the time of a child’s birth, paternity is established without further action. In the event the parents are unmarried, both parties can voluntarily establish paternity before leaving the hospital.

By Acknowledgement or Legitimation

If the parents are unmarried at the time of the child’s birth but marry later, the child’s paternity can be established when the parents file for a marriage license. If the parents plan to remain unmarried, both parents can still voluntarily establish paternity.

By Order

If paternity hasn’t been established at birth in the hospital or by acknowledgement or legitimation, it can be done so through an order. This option typically involves genetic testing. It can be ordered by the Florida Department of Revenue or a judge can order paternity in court.
