Do I Need a Lawyer to Establish Paternity in Florida?
There are many circumstances in which a paternity lawyer will be a powerful asset to you in establishing or contesting paternity. A name on a birth certificate is not enough to establish (or contest) paternity in Florida. Instead, turning to a paternity lawyer for legal representation can help you guide this complicated and often emotional process.
Keep in mind, if you are the father of a child born out of wedlock in Florida and paternity was not voluntarily established, you do not have legal rights to the child. In order to get these rights, paternity must be legally established. Once paternity is issued and your rights are established with the help of a paternity lawyer, your right to parenting time/child custody and/or visitation can be protected.
In some cases, you may also be unsure if you are the biological parent of a child you are paying child support for. In these cases, a DNA test is strongly encouraged for establishing or contesting paternity.
Alternatively, if you are the mother of a child who is seeking to establish paternity for that child, a paternity lawyer in Port Saint Lucie can help ensure you and your child receive the child support and compensation that is legally and fairly owed to you.
What are the Three Ways to Establish Paternity?
When two parents are married at the time of a child’s birth, paternity is established without further action. In the event the parents are unmarried, both parties can voluntarily establish paternity before leaving the hospital.
If the parents are unmarried at the time of the child’s birth but marry later, the child’s paternity can be established when the parents file for a marriage license. If the parents plan to remain unmarried, both parents can still voluntarily establish paternity.
If paternity hasn’t been established at birth in the hospital or by acknowledgement or legitimation, it can be done so through an order. This option typically involves genetic testing. It can be ordered by the Florida Department of Revenue or a judge can order paternity in court.
